End-User License Agreement for the software product “stage Plugin”: a plugin for MAXON’s Cinema 4D

IMPORTANT: PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE INSTALLING THE PROGRAM

For the purposes of this agreement hantmade GmbH, a company registered in the Germany, shall be considered as the supplier of the plugin “stage Plugin”.

This End-User License Agreement (“EULA”) is a legal agreement between you, the Authorized User (either an individual or a single corporate entity), and hantmade for the software product identified above, which may include associated software components, media, printed materials, and online or electronic documentation.

By installing, copying, or otherwise using stage Plugin you agree to be bound by the terms of this EULA.

This license agreement represents the entire agreement concerning the program between you (“the licensee”) and hantmade (“the licensor”), and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the stage Plugin.

The stage Plugin is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The plugin is licensed, not sold.

     1. GRANT OF LICENSE

the stage Plugin is licensed as follows:

(a) Installation and Use.

hantmade grants you the right to install and use a copy of the plugin on one computer running a validly licensed copy of MAXON’s Cinema 4D. If you wish to use the plugin on more than one computer, you must purchase an appropriate number of additional licenses.

(b) Backup Copies.

You may also make copies of the plugin as may be necessary for backup and archival purposes.

(c) Individual licences

An individual licence of stage Plugin is locked to a single serial number of Cinema 4D. The stage plugin serial number therefore cannot be changed after purchase. It is your responsibility to enter your Cinema 4D serial number correctly when purchasing. In cases of genuine error hantmade will consider each case on an individual basis.

(d) Upgrades to Cinema 4D

Upgrades to a new version of Cinema 4D will always require a new serial number for the stage Plugin.

Normally this will be provided free of charge. hantmade reserves to right to refuse to provide new serial numbers in cases of suspected software piracy.

     2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

(a) Maintenance of Copyright Notices.

You must not remove or alter any copyright notices on any and all copies of stage Plugin.

(b) Distribution.

You may not distribute registered copies of stage Plugin to third parties. Evaluation versions available for download from the stage website may be freely distributed.

(c) Prohibition on Reverse Engineering, Decompilation, and Disassembly.

You may not reverse engineer, decompile, or disassemble this plugin, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

(d) Rental.

You may not rent, lease, or lend the software.

(e) Support Services.

hantmade may provide you with support services related to the plugin (“Support Services”). Any supplemental software code provided to you as part of the Support Services shall be considered part of the software and subject to the terms and conditions of this EULA.

(f) Compliance with Applicable Laws.

You must comply with all applicable laws regarding use of the software.

     3. TERMINATION

Without prejudice to any other rights, hantmade may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the plugin in your possession.

     4. COPYRIGHT

All title, including but not limited to copyrights, in and to stage Plugin and any copies thereof are owned by hantmade. All title and intellectual property rights in and to the content which may be accessed through use of stage Plugin is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by hantmade.

     5. NO WARRANTIES

hantmade expressly disclaims any warranty for the stage plugin . The plugin is provided “As Is” without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. hantmade does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within stage plugin. hantmade makes no warranties in respect of any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. hantmade further expressly disclaims any warranty or representation to Authorized Users or to any third party.

     6. LIMITATION OF LIABILITY

In no event shall hantmade be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of “Authorized Users” use of or inability to use the stage plugin, even if hantmade has been advised of the possibility of such damages. In no event will hantmade be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. hantmade shall have no liability with respect to the content of stage plugin or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information. Installation of the software indicates your acceptance of these condtions.

     7. PRICES AND PRICE QUOTATIONS

All price quotations and agreements are net prices in Euros (€) to which the current legal value-added tax (VAT) is to be added in each case - even in the absence of explicit textual indications.

All the prices are always, if nothing else is agreed upon, plus the relevant statutory value added tax, other taxes and charges.

Orders within the EU will be executed VAT-free, if the VAT-ID number has been told by the customer during the order process.

Firms and private customers of third countries (i.e. USA) shall be obliged to pay the VAT and other taxes resulting from these transactions to the competent tax authorities.

Prices are only valid for the delivered product quantities.

     8. REFUNDS-POLICY

Please be sure that the plugin you purchase is compatible with the system you have, before you make your

purchase. Test the demo Version and if you have any question, create a ticket and ask support.

• Once you have used a plugin, you can not get a refund.

• If you purchase a plugin that is not compatible with the system you are running on, you

are not entitled to a refund.

• You can only get a refund if you made a genuine mistake during the ordering process.

• Refunds can only ever be issued on credit card transactions and only within 30 days of your order.

     9. REQUIERMENTS

• Cinema 4D R15 or newer with a single user License (Cineware does not support plugins)

• Can be used on multiple computers, just as your c4d License permits.(MAC + PC + Laptop,ect)

• the Stage License is limited to a single Cinema 4D License and can`t change to a different c4d

License, only for C4D version update , e.g. from R15 to R16 and only one key per license and per

version

    10. SUPPORT

• every plugin come with one year support from the day of purchase.

• Help and support can only be given on topics directly relating to products we sell. We can not,

and explicitly will not provide free support for third party services or products.

• we only offer email or ticket based support.
